Medicaid Planning
The costs of long term care are staggering and can quickly deplete your life savings.  Often times, families become destitute before ever applying for government benefits.  With proper planning, this does not have to happen.  There are a number of legal and ethical strategies available to you to help protect your nest egg.

Medicaid is a federal program, governed locally by the State of Delaware, that can help finance the costs of long term care.  The attorneys and staff at Procino-Wells & Woodland, LLC act as advocates for you and your family to achieve Medicaid eligibility.  They eliminate the misconceptions associated with Medicaid and guide you through the complex rules and processes.  Moreover, because they understand the intricacies of the laws, they can help you protect your assets by way of proven planning strategies.
After a consultation and intake meeting, we are able to fully analyze your family’s current situation through a written Asset Protection Plan.  This analysis provides a roadmap for the steps ahead, which often includes implementation of asset protection planning strategies.  After implementation of the plan, our team then completes and submits the Medicaid application on your behalf.  We guide you and are there for you every step of the way.

VA Pension Planning
The Department of Veterans Affairs offers many benefits to veterans and their surviving spouses.  Unfortunately, more times than not, eligible individuals do not realize the benefits available to them.  At Procino-Wells & Woodland, LLC, the attorneys are accredited by the VA.  This means that they can advocate for their clients by preparing, presenting, and prosecuting claims before the VA.

Our focus is on a type of benefit called VA Pension with Aid and Attendance.  For veterans and their surviving spouses, this is a monthly monetary benefit that is paid by the VA when the claimant is in need of the aid of another person in order to perform personal functions required in everyday living, such as bathing, feeding, and dressing.
Sometimes, both Medicaid and Veterans benefits are sought at the same time.  In other instances, one is sought over the other.  Regardless, the benefit paid by the VA can exceed $1,000.00 per month and can be a critical part of an overall plan.
Stages of planning
Crisis Planning is recommended for a senior who is currently receiving or eligible to receive long term care at home, in assisted living, or in a nursing home.  Even if a senior has been privately paying for long term care and still has some assets remaining, it is not too late to plan!
Intermediate Planning is recommended for a senior who does not currently need long term care, but who will likely need it within the next five years.
Pre-Planning is recommended for a healthy senior who does not expect to need long term care within the next five years. During this stage of planning, irrevocable Asset Protection Trusts are utilized to shelter the assets that are transferred to the Trusts… [read more]
